If you received notice from Compex Legal Services, Inc. indicating that your Personally Identifiable Information ("PII") and/or Protected Health Information ("PHI") may have been disclosed in the Cyber Incident, which occurred in April 2024, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (1) the Judge(s) presiding over the Actions, and members of their families, (2) the Defendant, its subsidiaries, parent companies, successors, predecessors, and any entity in which the Defendant or its parents have a controlling interest and their current or former officers, directors, and employees, (3) Persons who properly execute and submit a Request for Exclusion prior to the expiration of the Opt-Out Period, and (4) the successors or assigns of any such excluded Persons.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by August 19, 2026.

Compex Legal Services, Inc. has agreed to pay $872,500.00 (the “Settlement Fund”) to settle this Litigation. The Settlement Fund will be used to pay benefits to the Class Members who have identifiable and valid mailing and/or email addresses, the costs of notice and claims administration, attorneys’ fees and costs, Service Awards to the Plaintiffs and other court approved costs and expenses reasonably contemplated by the Settlement.

Documented Losses. If you suffered verifiable financial losses that are reasonably traceable to the Cyber Incident, you may be eligible to receive a payment to compensate you for the losses and inconveniences suffered. If verified that you meet all the criteria described in the Settlement Agreement, you may be eligible to receive reimbursement of your documented losses of up to $5,000.00. The benefit covers eligible losses or expenses like:

  • payments for identity theft protection or credit monitoring you made which are reasonably traceable to the Cyber Incident

  • financial losses due to stolen identity traceable to the Cyber Incident

  • fees for a professional service to remedy identity theft

  • credit monitoring service costs

You need to send proof, like receipts, account statements, etc. You may also support losses by submitting information in the claim form that describes efforts spent remedying suspected identity theft, fraud, or misuse of personal information and/or other issues reasonably traceable to the Cyber Incident. Examples of what can be used to account for your losses related to remedying issues related to the Cyber Incident include: documents related to monitoring credit, resolving disputes for unauthorized transactions, freezing or unfreezing your credit, remedying a falsified tax return, etc. Losses, however, cannot be documented solely by a personal certification, declaration or affidavit, or by a handwritten receipt, and lost-time claims will not be reimbursed.

Flat Cash Payment. All Class Members may claim for a cash payment. This payment is expected to be between $100.00-$200.00. This payment is subject to pro rata adjustment.

The deadline to submit a Claim Form online is August 19, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than August 19, 2026.
